Booking & Cancellation Policy

    1. Purpose, Scope, and Contractual Status

    This Booking & Cancellation Policy (“Policy”) governs booking, payment, cancellations, rescheduling, refunds, and disputes for date-specific leisure services (“Activities”) offered by:

    This Policy forms an integral part of your contract with WYND and must be read together with the Website Terms & Conditions.

     

    1. Nature of Activities (Date-Specific Leisure Services)

    Activities are provided on fixed dates or within fixed periods. WYND commits capacity and operational resources in advance (crew, vessel/venue, suppliers). Therefore:

    • bookings are capacity-limited,
    • cancellation rules are strict,
    • last-minute refunds are generally not possible.

     

    1. Booking Process and Contract Formation

    3.1 Booking Request
    A booking request can be submitted via the Platform or in writing (email).

    3.2 Booking Confirmation
    A binding contract is concluded only when WYND issues a written booking confirmation (email/portal confirmation).

    3.3 Acceptance / Refusal
    WYND may refuse booking requests for capacity, safety, compliance, or community integrity reasons.

     

    1. Inclusions and Exclusions

    4.1 Included Services
    Inclusions are stated in the Activity description and booking confirmation.

    4.2 Exclusions (Unless Explicitly Included)
    Typically excluded:

    • flights/transport to/from destination,
    • visas/permits/vaccinations,
    • insurance (travel, health, cancellation),
    • personal expenses,
    • optional add-ons not listed as included.

     

    1. Prices, Currency, Taxes, and Fees

    Prices are shown in the booking flow. Unless explicitly stated:

    • you bear bank/FX fees,
    • third-party processing fees may apply,
    • local taxes or fees may be charged depending on destination/service design.

     

    1. Payment Terms

    6.1 Due Date
    Unless otherwise agreed, full payment is due prior to the Activity start date, by the deadline in the booking confirmation.

    6.2 Payment Methods
    WYND may accept cards, bank transfers, and other methods, including $WYND where explicitly offered.

    6.3 Late / Failed Payments
    Failure to pay on time may result in:

    • cancellation,
    • loss of reserved capacity,
    • application of cancellation fees.

     

    1. Participant Cancellations

    Unless booking-specific terms say otherwise, the following cancellation fees apply:

    • Up to 90 days before start:50% of the total booking price
    • Up to 60 days before start:75%
    • 30 days or less / No-Show:100%

    7.1 Notice Form
    Cancellations must be submitted in writing (email sufficient). The decisive time is when WYND receives the notice.

    7.2 Rationale
    These fees reflect operational commitments and limited capacity.

     

    1. No-Show, Late Arrival, Early Departure

    No refunds for:

    • No-Show,
    • missed transport connections,
    • late arrival,
    • early departure,
    • partial participation for personal reasons (including illness), unless mandatory law requires otherwise.

     

    1. Rebooking, Credits, and Goodwill

    9.1 No Automatic Right
    There is no entitlement to rebooking/credits.

    9.2 Discretionary Options
    WYND may, at its discretion, offer:

    • rescheduling, or
    • a credit for a future Activity.

    9.3 Credit Rules
    Credits:

    • may be non-transferable,
    • may expire,
    • are not cash equivalents,
    • may be subject to price differences.

     

    1. Changes or Cancellation by WYND

    WYND may modify or cancel an Activity due to:

    • safety considerations,
    • force majeure,
    • minimum-participant thresholds,
    • technical/logistical constraints.

    If WYND cancels, paid amounts for the cancelled Activity are refunded. Additional compensation is excluded unless mandated by law.

     

    1. Force Majeure

    Force majeure includes severe weather/sea conditions, pandemics, war, strikes, political unrest, and government/port authority actions. WYND is not liable for delay/non-performance caused by force majeure.

     

    1. EU Consumer Withdrawal Rights

    For leisure services on specific dates/periods, statutory withdrawal rights are generally excluded by law. WYND Activities fall under this statutory framework.

     

    1. Chargebacks and Payment Disputes

    Unjustified chargebacks may result in:

    • immediate suspension,
    • recovery of costs,
    • exclusion from future bookings.

     

    1. Governing Law and Jurisdiction

    German law applies. Jurisdiction (where permissible): Hamburg, Germany.
